(ولا يرثه) أي: المرتد (أحد) من المسلمين؛ لأن المسلم لا يرث من الكافر ولا من غير المسلمين؛ لأنه يخالفهم في حكمهم؛ لأنه لا يقر على ما هو عليه من الردة.
