(ولبنت وجدة نصفهما حُر؛ المال بينهما نصفين بفرض ورَدٍّ، ولا يرد هنا) أي: في هذه الصورة وشبهها (على قَدْر فرضيهما؛ لئلا يأخذَ مَن نصفه حر فوق نصف التَّرِكة) وهو ممنوع.
