(فإن أسلما) أي: السيد وعبده (أو) أسلم (أحدهما، أو) لم يُسلِما، ولكن (ترافعا إلينا أمضينا العقد، إن كان موافقًا للشرع) لقوله تعالى: {فَاحْكُمْ بَينَهُمْ بِمَا أَنْزَلَ اللَّهُ}.
