(و) له (أن يزوِّجها) أي: الأجنبية (لمن شاء، بلا إذنها وإذن وليها (٨) ، و) أن (يتولَّى طرفي العقد) لقوله تعالى: {النَّبِيُّ أَوْلَى بِالْمُؤْمِنِينَ مِنْ أَنْفُسِهِمْ} .
