(ويقدَّم هنا ابنه، وإن نزل على أبيه) لأنه أحق بالميراث، وأقوى في التعصيب. وإنما قُدِّم الأب النسيب لزيادة شفقته، وفضيلة ولادته، وهذا معدوم في ابن المعتق، فرجع فيه إلى الأصل.
