(وإن لم يكن ادَّعى ذلك) أي: السبق قبل موته (وأنكر الورثة) كونه السابق (فالقول قولهم مع أيمانهم) أنهم لا يعلمون أنه السابق؛ لقوله - صلى الله عليه وسلم -: "واليمين على من أنكر"
