(ولا ينعقد نكاح مسلم بشهادة ذميين) ولا بشهادة مسلم وذمي؛ لقوله تعالى:{وَأَشْهِدُوا ذَوَيْ عَدْلٍ مِنْكُمْ} (ولو كانت الزوجة ذمية) كتابية، أبواها كتابيان.
