(و) يثبت الخيار أيضًا (بحدوثه) أي: العيب (بعد العقد، ولو بعد الدخول؛ قاله الشيخ) في "شرح المحرر" (وتعليلهم) بأنه عيب أثبتَ الخيار مقارنًا، فأثبتَه طارئًا، كالإعسار والرق (يدل عليه) أي: على ما قاله الشيخ من ثبوت الخيار ولو بعد الدخول
