(فإن أتونا قبل عقده) أي: النكاح (عقدناه على حكمنا) بولي وشهود وإيجاب وقَبول؛ لقوله تعالى:{وَإِنْ حَكَمْتَ فَاحْكُمْ بَيْنَهُمْ بِالْقِسْطِ}.
