(وإن أسلم البعض) من الزوجات (وليس البواقي كتابيات؛ مَلَك إمساكًا وفسخًا في مسلمة خاصة) إن زادت المسلمات على أربع، وليس له أن يختار واحدة ممن لم يُسْلمنَ؛ لعدم حِلِّها له.
