(ولا يملك) من قُدِّم إليه طعامٌ (الطعامَ الذي قُدِّم إليه، بل يهلك على ملك صاحبه) لأنه لم يُمَلِّكه شيئًا، وإنما أباحه الأكل، ولهذا لم يملك التصرف فيه بغير إذنه
