(و) يصلي (عريانًا مع) وجود ثوب (مغصوب) لأنه يحرم استعماله بكل حال، لعدم إذن الشارع في التصرف فيه مطلقًا، ولأن تحريمه لحق آدمي، أشبه من لم يجد إلا ماء مغصوبًا.
