(غيبة ظاهرها السَّلامة) كتاجر، وأسير عند من ليست عادته القتل (ولم يُعلَم خبره) أي: حياته ولا موته (وتضرّرت زوجتُهُ بترك النكاح) مع وجود النفقة عليها (لم يفسخ نكاحها) لتضررها بترك الوطء؛ لأنه يمكن أن يكون له عذر.
