(ولا يفتقر الخُلْع إلى حاكم، نصًّا (٤) ) ورواه البُخَارِيّ عن عمر وعثمان؛ ولأنه إن قيل: إنه عقد معاوضة؛ كان كالبيع، أو قيل: إنه قَطْعُ عقد بالتراضي؛ كان كالإقالة، وكلٌّ منهما لا يفتقر إلى حاكم.
