(وإن كانا) أي: المتخالعان (يجهلانه) أي: يجهلان كونه محرَّمًا، بأن لم يعلما أنه حُرٌّ أو خمر (صحّ) الخُلْع (وكان له بَدَلُه) أي: مِثل المِثْلي، وقيمة المتقوّم؛ لأن الخلع معاوضة بالبُضع، فلا يفسد بفساد العوض، كالنكاح.
