وإن أراد الوطء حال الإحرام أو الصيام الفرض أو قبل تكفيره للظهار فمتعته لم يسقط حقها كما لو منعته في الحيض:

(وإن أراد الوطء في حال الإحرام، أو) أراد الوطء في (الصيام الفرض، أو) أراد الوطء (قبل تكفيره للظِّهار، فمنعته؛ لم يسقط حقها) من طلب الفِيئة؛ لأنه وطء حرام إذًا، فلا يلزم التمكين منه (كما لو منعته في الحيض) من الوطء.
