(وإن كان ما اشتراه المكاتَب غير ذوات محارِمه أن حاضت عنده) أي: المكاتَب (وأخذها السيد لعجزه؛ لزمه الاستبراء) لأنه ليس للسيد ملك على ما في يد مكاتبه؛ ولأنه تجدَّد له ملك.
