(ولا يكون استبراء إلا بعد ملك المشتري لجميع الأَمَة، فلو ملك بعضها، ثم ملك باقيها؛ لم يُحْتَسَب الاستبراءُ إلا من حينَ مَلَكَ باقيَها) لأنه وقت حصولها كلها في ملكه.
