(ولو اتفقا) أي: أبو المحضون وأمه (على أن يكون) الولد (في حضانتها، وهي) أي: الأم (مزوّجة، ورضي زوجها؛ جاز) ذلك (ولم يكن لازمًا) لأن الحق لا يعدوهم، وأيهم أراد الرجوع فله ذلك.
