(ولا تثبت الحضانة على البالغ الرشيد العاقل) لأنه استقلَّ بنفسه، وقدر على إصلاح أموره بنفسه، فوجب انفكاك الحَجْر عنه (وإليه الخيرة في الإقامة عند من شاء من أبويه) لأنه لم تثبت الولاية عليه لأحد.
