(ولا يُخَيّر) الغلام (إذا كان أحد أبويه ليس من أهل الحضانة) لأن غير الأهل وجوده كعدمه (وتعيّن أن يكون) الغلام (عند الآخر) الذي هو أهل للحضانة، كما قبل السبع.
