(وعمد الصبيِّ والمجنون خطأ لا قِصاص فيه) لأنه عقوبة، وغير المكلَّف ليس من أهلها. (والدِّيَةُ على العاقلة حيث وجبت) في الخطأ (والكفَّارة في ماله) في الخطأ وما أجري مجراه.
