(ويُقتل الولد (٢) ) المكلَّف، ذكرًا كان أو أنثى (بكلِّ واحدٍ من الأبوين المكافئين وإن عَلَوَا) للآية، والأخبار، وموافقة القياس. وقياسه على الأب ممتنع؛ لتأكّد حرمته؛ ولأنه إذا قُتِل بالأجنبي، فبأبيه أولى، ولأنه يُحَدّ بقذفه، فَيُقتل به، كالأجنبي.
