(وإن كان) الأخ القاتل لأخيه (محجوبًا عن ميراثه كله) بابن، أو ابن ابن (فلوارثِ القتل) وهو وارث المال (قتل الآخر) لإرثه دمه وعدم المانع، وله العفوُ إلى الدية أو مجانًا.
