(ومتى اختار) الولىُّ (الديةَ تعيَّنتْ، وسقط القودُ) قال أحمد: إذا أخذ الدية فقد عفا عن الدم (ولا يملك طلبَه) أي: القود (بعدُ) أي: بعد اختيار الدية؛ لأنه إذا سقط لا يعود
