(فإن كان الثقب في غير محلِّه، أو كانت) الأذن (مخرومة، أُخذت بالصحيحة) لأنه رضي بدون حَقّه (ولم تؤخذ) الأذن (الصحيحة بها) أي: بالمثقوبة في غير محلّ الثقب، أو بالمخرومة؛ لأنه عيب، فتفوت المساواة
