(ولا) يُستوفى (بآلة يُخشى منها الزيادة) لأنها عدوان (وسواءٌ كان الجُرح بها) أي: بالآلة التي يُخشى منها الزيادة (أو بغيرها) لحديث: "إنَّ الله كَتب الإحسان على كل شيءٍ".
