(وكذلك إن حَفَرها) أي: البئر (في موات) لِتَمَلُّكٍ، أو ارتفاقٍ، أو نفع المسلمين (أو وضع حجرًا) بطين ليطأ عليه الناس، أو وضعه في موات (أو نصب شَرَكًا أو شبكة أو مِنجلًا ليصيد بها) فتلف بذلك شيء، فلا ضمان؛ لعدم تعديه.
