(وإن حَفَرها) أي: البئر (في ملك مشترك بينه وبين غيره بغير إذنه، ضَمِن ما تلف به) أي: بسبب حفره (جميعه) لتعدِّيه بالحفر (وتقدمت أحكام البئر في آخر الغصب (١) .
