(وإن كان أحدهما يسير، والآخر واقفًا) أو قاعدًا (فعلى عاقلة السائر دِية الواقف) و القاعد؛ لأنه قتله خطأ (وعليه) أي: السائر (ضمانُ دابته) أي: دابة الواقف أو القاعد؛ لأن العاقلة لا تحملها
