(وإن تعمَّده) أي: الزائد (العادُّ فقط) ضَمِنه وحدَه دون الضارب وغيره (أو أخطأ) العادُّ (في العدد، وادعى الضارب الجهل؛ ضمنه العادُّ) هكذا في بعض النسخ، وقاله في "الإنصاف" وغيره،
