(مِلْكٌ له) أي: للميت؛ لأنه مالك له في حياته، ولا يزول ملكه إلا عمَّا لا حَاجَةَ له إليه (فلو عُدم الميت) وبقي الكفن (وُفِّيتْ منه ديونه) ويزيد به الثلث في الوصية، كسائر ماله
