(وإن أعانهم) أي: البُغاة (أهل ذِمةٍ أو عهدٍ، انتقض عهدهم) بإعانتهم لهم طوعًا مع علمهم بأن ذلك لا يجوز، كما لو انفردوا بقتالهم (وصاروا أهل حَربٍ) تحل دماؤهم وأموالهم
