(فأما اليمين على الماضي فليست مُنعقِدةً) لأن شرط الانعقاد إمكان البِر والحنث، وذلك مُتعذِّر في الماضي. (وهي) أي: اليمين على الماضي (نوعان: غموس، وهي التي يحلف بها) على الماضي
