(ويُعتبر نطقه) أي: الحالف (به) أي: بالاستثناء، بأن يتلفَّظ به (ولا ينفعه) الاستثناء (بالقلب، إلا من مظلوم خائف) ولم يقيد في "المستوعب": خائف؛ لأن يمينه غير منعقدة؛ أو لأنه بمنزلة المتأوّل.
