(وإن مات) العامل أو الوالي أو القاضي (قبل إمكان رفعه إليه، حَنِث) الحالف؛ لأنه قد فات رَفعُه إليه، أشبه ما لو حلف: ليضربنَّ عبده في غَدٍ، فمات العبدُ اليوم.
