(و) لو حلف: (لا يتصدَّق عليه، فوهبه، لم يحنث) لأن الصدقة نوعٌ من الهبة. ولا يحنث الحالف على نوعٍ بفعل نوع آخر، ولا يثبت للجنس حكم النوع.
