(و) من حلف: (لا يَشَمُّ طيبًا، فَشَمَّ نبتًا ريحه طَيِّب) كمَرْزَجوش ونحوه مما تقدم في الطيب في الإحرام (حَنِثَ) لأنه يتناوله اسم الطيب و (لا) يحنث إن شَمَّ (فاكهة) لأنها ليست من الطيب.
