(وتصح تولية مفضول مع وجود أفضل) منه؛ لأن المفضول من الصحابة كان يولَّى مع وجود الفاضل، مع الاشتهار والتكرار، ولم يُنكر ذلك أحد، فكان إجماعًا.

وتصح -أيضًا- تولية حريص عليها بلا كراهة.
