(ولا يجوز أن يقلِّد القضاءَ لواحد على أن يحكم بمذهب بعينه) لقوله تعالى: {فَاحْكُمْ بَيْنَ النَّاسِ بِالْحَقِّ} والحق لا يتعيَّن في مذهب، وقد يظهر الحق في غير ذلك المذهب.
