(ويصحُّ) تعليق (توليةِ قضاءٍ، و) توليةِ (إمْرَةِ (٣) ) بلدٍ أو سريةٍ ونحوها (بشرطٍ) لأن النبيَّ - صلى الله عليه وسلم - علَّق ولاية الإمارة بعد زيد على شرط ، فكذا ولاية الحكم.
