(وإن كان) القاضي (من (٢) لا يصلُحُ) للقضاء (لفسق أو غيره، نَقَض أحكامَه كُلَّها) ولو وافقت الصواب؛ لأن حكمه غير صحيح، وقضاؤه بمنزلة العدم؛ لفَقْدِ شرط القضاء فيه.
