(ثم إن شاء) القاضي (قال) للخصمين: (من المُدَّعِي منكما؟) لأن سؤاله عن المُدَّعي منهما لا تخصيص فيه لواحدٍ منهما (وإن شاء) القاضي (سَكَتَ حتى يبتدئَا) أي: حتى تكون البداءة بالكلام من جهتهما
