(وإن جهل) الحاكم (حالَه) أي: الشاهد (طلب من المُدَّعي تزكيته) لقول عمر للشاهدين: "جيئا بمن يعرفكما"؛ ولأن العدالة شرط، فالشكُّ في وجودها كعدمها، كشروط الصلاة.
