(وليس تقدمُ الإنكار في الدعوى على غائب ونحوه شرطًا) إذِ الغَيبة ونحوها، كالسكوت، والبينة، تُسمع على ساكت، لكن لو قال: هو معترف، وأنا أُقيم البينة استظهارًا؛ لم تُسمع. وقاله الأدمى؛ ذكره في "المبدع" عن "الترغيب".
