(ومن قَلَّد) مجتهدًا (في صِحّة نِكاح) مختَلَف فيه (لم يفارق) المنكوحة (بتغير اجتهاده) أي: اجتهاد المجتهد الذي قلَّده في الصحة (كحُكْمٍ) أي: كما لو حكم به مجتهد يرى صحته حال الحكم ثم تغير اجتهاده؛ لقول عمر: ذاك على ما قضينا، وهذا على ما نقضي
