(وإن فَسَقَ) الكاتبُ (قبلَ الحكم بكتابه؛ لم يحكم به) لأن بقاء عدالة شاهدي الأصل شرطٌ في الحكم بشاهدي الفرع، فكذلك بقاء عدالة الحاكم؛ لأنه بمنزلة شاهدي الأصل.
