(ويَقسم حاكمٌ مع غيبة وَليٍّ، وكذا) يقسم حاكمٌ (على غائبٍ في قِسْمَةِ إجبارٍ) لأنها حقٌّ على الغائب، فجاز الحكم عليه به كسائر الحقوق.
