(ويُشترط أن يكون القاسم) الذي ينصبه الحاكم (مسلمًا عدلًا) لِيُقبل قوله في القسمة (عارفًا بالقِسْمة) ليحصُل منه المقصود؛ لأنه إذا لم يعرفها، لم يكن تعيينه للسهام مقبولًا
