(فإنْ قَسَمَه) الحاكمُ بينهم (ذكر في كتاب القِسْمَةِ أنه قَسَمَه بمُجرَّدِ دعواهم بملكه، لا عن بينة شَهِدت لهم بمِلْكهم) لئلا يتوهم الحاكم بعده أن القِسْمة وقعت بعد ثبوت ملكهم، فيؤدّي ذلك إلى ضرر من يدَّعي في العين حقًا
